The Question

Did DigitalConvergence.com use the Anonymizer to access killcat.com without agreeing to killcat.com's Obnoxious and Capricous License Agreement?

The evidence below is only circumstancial, but it would be very ironic for a company making a consumer-tracking technology (the CueCat) with an obnoxious License Agreement to (1) try to remain anonymous themselves so as to (2) avoid leaving a log-file trail showing they have accepted killcat's License Agreement.

The Evidence

On October 31, 2000, killcat.com began receiving its first hits.

On November 1, 2000 at 10:52 AM we received our first (and to date, only) hit from dallas.digitalconvergence.com -- someone at DigitalConvergence.com viewed the top-most page showing the killcat.com Website End-User License Agreement.

At 11:01, approximately 10 minutes later, we received our first hit(s) from someone using the Anonymizer, www.anonymizer.com, a web-proxy service which masks identity.

At 11:03, an anonymous entity then entered the killcat.com site via the entrance-link reserved for "EVERYONE except the DigitalConvergence.com Gang". An anonymous entity then proceeded to browse the site.
